Abstract
The law punishes manufacturers who embrace safely innovation and product improvement. The “new” is literally the enemy of the “old” in the sense that a new safety design may be used by the law to show that all past and current designs are defective. On the other hand, if the new design is patented, a special attribute precludes its invocation as a remedial measure for a safety problem which predated the patent.
